Usage guidelines for customers, licensees, and other third parties

McAfee's philosophy on trademarks and brands
McAfee's trademarks and brands are McAfee intellectual property and are important and valuable assets of the corporation. Trademarks must be used properly. Follow these Guidelines for using McAfee's trademarks and brands properly in all communications, documents, and electronic messages.

Who do these guidelines apply to?
These Guidelines apply to McAfee employees, customers, licensees, consultants, outside vendors, and other third parties.

If you are a LICENSEE of a McAfee trademark or logo under a marketing program agreement or other business alliance agreement, the license agreement may have special permissions or usage guidelines in addition to or that supersede the guidelines set forth below.

If you are a supplier of products or services to McAfee, you may only display or use the McAfee trademarks in accordance with your agreement with McAfee. You may not use a McAfee trademark in a manner that implies endorsement or approval of your products or services by McAfee without specific written permission from McAfee.

Any and all other displays of a McAfee trademark or logo must follow the guidelines below.

Using McAfee's trademarks and logos
You are permitted to refer to McAfee products and services by their associated trademark or service name, as long as such references:

• are truthful, fair, and not misleading;
• do NOT misrepresent, mislead, suggest, or otherwise confuse users into believing McAfee is the source of goods or services not actually made or provided by McAfee or its subsidiaries; and
• comply with these policy Guidelines, which McAfee may modify from time to time at its sole discretion.

Your use or display of a McAfee trademark must always: (a) use the McAfee trademark as an adjective, including an appropriate noun after the trademark; and (b) include appropriate acknowledgement of the McAfee ownership of the trademark.
You may NOT, and are specifically prohibited from:

• Including a McAfee trademark or logo into the name(s) of your products, services, domain names, trademarks, logos, or company.
• Adopting trademarks or logos for your products, services, domain names, trademarks, logos, or company names that are confusingly similar to a McAfee trademark or logo.
• Making any use of any McAfee name, mark, or logo in connection with your goods or services that improperly suggests that McAfee is the source of or otherwise approves of or is connected with your goods or services, when no such express source, approval, or connection exists.
• Making unlicensed use of any McAfee logo (contact your McAfee marketing or sales representative for business programs that may include licensed use of certain McAfee trademarks).

• ALWAYS use a trademark as an adjective, accompanied by an APPROPRIATE noun. Do not use a trademark as a noun. Do not pluralize a trademark or make it possessive (which would be using it as a noun). Do not join a trademark to other words, symbols, or numbers, either as one word or with a hyphen. And do not abbreviate a trademark.
• ALWAYS use the proper spelling and the proper trademark symbol. For the trademark symbol, the superscript or subscript mode is preferred, but if it is not available, use parentheses: (TM), (SM.) or (R).
• ALWAYS use trademarks and brand names in the ways they were intended to be used. Do not use them for goods or services for which they were not originally intended. Do not alter them in any way. Do not make puns out of them or portray them in a negative light.

• As with all other trademarks, the trademark should be used as an adjective and not as a noun. This means that an appropriate and approved noun must accompany the trademark.
• Use the appropriate trademark symbols with each trademark.
• Use the trademark symbol in the first appearance in the body of text, and in the most prominent instance (e.g., a paragraph headline) when permitted by space and an applicable style guide.
• Never hyphenate or abbreviate the trademark.
• Never incorporate the trademark or any part of the trademark into a third party's company name, product brand name, or model number.

McAfee product names not listed on the Names List
Many McAfee product names are not specifically listed on the Names List (McAfee® AntiVirus Plus, McAfee® Internet Security, McAfee® Network Threat Response).  For these names:

• They must always be preceded by “McAfee” (e.g., never just “AntiVirus Plus”)
• They must always be spelled out at every instance (i.e. do not abbreviate)
• They do not have a specific noun.

Trademark Symbols and Acknowledgements

Trademark Symbols
Following are guidelines for the use of trademark symbols for McAfee’s trademarks:

• Properly designate (with ®, ™ or SM) in the appropriate location of the name as shown on the Names List.
• For graphic images appearing in charts, graphs, graphics, word processing, etc., trademarks should also be designated with the proper symbol.

Following are guidelines for the use of trademark acknowledgments for McAfee’s trademarks:

• Properly footnote and acknowledge trademark ownership, preferably identifying McAfee marks as being owned by McAfee, Inc. For example: McAfee, the McAfee logo, and SiteAdvisor are trademarks or registered trademarks of McAfee, Inc. in the United States and other countries.
• The list of McAfee trademarks to provide acknowledgement for are on the McAfee Trademarks and Approved Nouns list.
• Note that some McAfee trademarks licensed by McAfee to you may have specific contractual acknowledgment requirements or other restrictions. Refer to your contract or license for specific requirements.

Third-Party Use of McAfee Code Names

Statement on Third-Party Use of McAfee Code Names

McAfee code names
McAfee uses internal code names to identify projects related to specific products or services that are in development and may or may not be publicly released. These code names are only for tracking purposes to aid in identifying a specific project, and are not indicative of that project's feature set, release time table, eventual brand name, or a promise or warranty that the project will be publicly released at all. If and when a code-named project is publicly released, it will receive and be promoted under a commercial brand name and all references to that product or service by the McAfee code name should cease entirely. Use of the correct McAfee commercial product names in advertising and marketing materials is essential to accurate and effective marketing communications, and to avoid potential legal claims based on the use of a McAfee code name.

Third-party use of McAfee code names
Customers, licensees, and other third parties are not authorized by McAfee to use McAfee code names in advertising, promotion, or marketing of any product or service. The use of any McAfee code name in advertising will automatically disqualify the advertisement from qualification for reimbursement under any McAfee cooperative marketing program, and could result in termination from McAfee marketing programs.

No liability, warranty, or indemnification for use of McAfee code names
McAfee does not represent or warrant that any McAfee code name is non-infringing or available for use in commerce. Use by customers, licensees, or other third parties of McAfee code names may provoke legal challenges from others claiming rights in such names, and may result in legal liability. McAfee accepts no responsibility or liability arising from or related to such third-party use (in any way) of McAfee code names. McAfee will not under any circumstances indemnify, defend, or hold harmless any customer, licensee, or other third party for the use of a McAfee code name. Third-party use of McAfee code names is at the user's sole risk.
