CITATION N.D. Cent. Code § 12.1-15-02
SUMMARY Anyone who is a party to a conversation or who has obtained consent from one party to the conversation may legally record or disclose the contents of any wire or oral communication so long as he does not have criminal or tortious / wrongful intent. N.D. Cent. Code § 12.1-15-02.
CONSENT REQUIRED 1 party to communication.
PENALTIES A person is guilty of a Class C Felony if he or she intentionally intercepts a wire or oral communication by use of an electronic device. A Class C Felony is punishable by up to 5 years imprisonment and up to a five thousand dollar ($5000.00) fine.
